You Got Married Abroad — Can You Use Your Foreign Marriage Certificate Directly in Vietnam?

You got married abroad and are holding a marriage certificate issued by the competent authority of the country where you got married.

Everything seems to be complete.

But when you return to Vietnam and start handling procedures related to civil status, residence, your child’s documents, property, visas, or other administrative matters, you may suddenly be told:

“This document needs to be translated.”

“The translation needs to be certified.”

“In this case, you also need to complete consular legalization.”

“You need to register the marriage with the Vietnamese civil status authority.”

And that’s when things start to get… confusing!

So, can a marriage certificate issued by a foreign authority be used directly in Vietnam? Do you simply need to have it translated and notarized?

The answer is: not always.

Depending on the country where the certificate was issued, the type of document, the purpose for which it will be used, and your specific circumstances, you may need to complete one or more procedures before the document can be used in Vietnam.

So, what do you need to do?

1. Check your marriage certificate first

Don’t rush to have it translated!

First, you need to check which authority issued the marriage certificate, whether the document you have is an original or a copy, whether all the information on the certificate is complete, and what the document will be used for in Vietnam.

This may seem like a simple step, but it is extremely important.

If you have not properly determined the legal status and requirements applicable to your document before having it translated, notarized, or certified, you may have to prepare your application again, resulting in additional costs and unnecessary trips to the relevant authorities.

2. Do you need consular legalization?

This is one of the issues that causes the most confusion.

Notarizing a translation is not the same as consular legalization.

Consular legalization is a procedure used to certify the seal, signature, and title of the signatory on foreign documents so that those documents can be considered for use in Vietnam, except where legalization is exempted or other regulations apply.

Therefore, you should not simply assume:

“Foreign document → translate into Vietnamese → notarize → done.”

In some cases, the document may need to undergo the relevant consular procedure before you can proceed with the next steps

3. Translate the marriage certificate into Vietnamese

Once you have confirmed that the document meets the necessary requirements, the next step is usually to translate the marriage certificate into Vietnamese.

Depending on the specific circumstances and the requirements of the authority receiving your application, the translation may need to be certified or notarized in accordance with applicable regulations.

This is particularly important for documents containing key information such as full names, dates of birth, nationalities, identification or document numbers, and the date of marriage registration. The translation must be accurate and consistent with the original document.

Even a small discrepancy in the spelling of a name or other personal information may result in the application being subject to further review or requiring corrections.

4. You may also need to register the marriage with the Vietnamese civil status authority

Another step that many people who get married abroad overlook is registration of the foreign marriage in Vietnam’s civil status records.

In cases where this procedure is required, the relevant person may need to complete the necessary formalities so that the marriage already registered with a competent foreign authority can be recorded in Vietnam’s civil status records.

Simply put, this step allows information about the marriage to be recorded in Vietnam’s civil status system in accordance with the regulations applicable to that particular case.

And this is precisely where preparing the correct documents from the beginning can make the entire process much smoother.

Don’t rush to have your marriage certificate translated!

A marriage certificate issued by a foreign authority may be required for many purposes in Vietnam, including civil status procedures, residence procedures, documents for children, property matters, visas, immigration or settlement procedures, and other administrative procedures.

However, the requirements may vary depending on the country where the document was issued and the specific circumstances of each case.

Some cases require relevant consular procedures.
Some require the document to be translated and the translation to be certified.
Some require additional procedures to register the foreign marriage in Vietnam’s civil status records.
